Search Wayne County Court Records

The Clerk's Access to Records page points to the same channels and treats them as ways to check public case information before making a copy request. The practical order is simple. Start with Indiana MyCase for a free public search. Use Doxpop court case search when its vendor search tools are useful or already available. Contact the Wayne County Clerk of Courts for the official record, a certified copy, an older file, or a document that is public but not linked online.
Before searching Wayne County court records, collect the party name, business name, case number, citation number, approximate filing date, or court name. Wayne County Court Record Types
Wayne County court records are not one file type. The Clerk of Courts keeps permanent records for the county trial courts, including the Chronological Case Summary, judgment records, court orders, and filings. Criminal matters include felonies, misdemeanors, and miscellaneous criminal files. Civil records include torts, plenary cases, protective orders, reciprocal support, small claims, and collection activity such as garnishment or proceedings supplemental. Family records include divorce, custody, support, juvenile paternity, CHINS, adoption, mental-health categories, and domestic relations filings, though some of those categories are restricted.
Probate is handled as a docket of the Wayne Circuit and Superior Courts rather than a separate probate court. Traffic, infraction, and ordinance records may be tied to Wayne Superior Court No. 3 or Hagerstown Town Court, depending on the citation. Protective-order case information is different. The Indiana Judicial Branch says protection-order cases are not searchable on MyCase because protected-person identifying details are excluded from online access. Public protective-order data is searched through the Indiana Protection Order Registry instead.

What Wayne County Court Records Show
A Wayne County court record usually combines case-identifying data with a running docket called the Chronological Case Summary, often shortened to CCS. The CCS is the timeline of court events. It can show when a case was filed, when a summons was issued, when service was returned, when hearings were set, when orders were entered, and when judgment or disposition occurred. Not every public document is linked online. Indiana MyCase help states that certain public documents can be available online, but if a public document is not linked, the user should contact the Clerk.

Wayne County Court Records Access
Public access to Wayne County court records is governed by both Indiana public-records law and Indiana court-record access rules. The Indiana Access to Public Records Act is the general rule for public agency records. Indiana Code 5-14-3-3 allows inspection and copying during regular business hours when the requester identifies the record with reasonable particularity. Indiana Code 5-14-3-4 lists mandatory and discretionary exceptions, including records made confidential by statute or court rule.
Court records also follow the Indiana Rules on Access to Court Records. Those rules control which court records are open, which are excluded, and how confidential material is handled. Wayne County's local copy rule is direct: the Clerk charges $1 per page, certification adds $3, and certified copies cannot be sent by email. Restricted Wayne County Court Records
Some Wayne County court records are not available through ordinary public search. Access to Court Records Rule 5 excludes categories of court records when law or court rule requires confidentiality. The Indiana Office of Court Services excluded-records guidance also explains the difference between records that are open and records that must be withheld or redacted. Common restricted categories include juvenile delinquency, CHINS, juvenile status matters, adoption, mental-health proceedings, sealed cases, granted expungements, protected-person identifying details, Social Security numbers, financial account numbers, and minor identifiers.
Expungement is especially important in criminal and arrest-related Wayne County court records. Indiana Code 35-38-9 controls when qualifying arrest, charge, conviction, and juvenile-allegation records may be sealed or removed from public access. Expunged or sealed court records are not erased from every government system. Courts, law-enforcement agencies, prosecutors, and other criminal-justice agencies may still have access when the law allows it. A request for a restricted record usually requires court authority, party access, attorney access, or a specific statutory basis.

Wayne County Record Requests
When online search is not enough, the Wayne County Clerk of Courts is the local office for official court copies. The Clerk's Office is in the northwest corner on the second floor of the courthouse. The Clerk maintains official court records, permanent records, judgments, civil and criminal records, probate documents, and the Chronological Case Summary.
